TERMS AND CONDITIONS OF ENGAGEMENT

Payment Responsibility
Oliver Constructions FNQ will arrange for a split invoice if required; however, the person to whom the quotation is addressed is responsible for the full payment of the account. -
Boundary Lines & Underground Services
It is the client’s responsibility to ensure correct boundary lines are clear and to check for underground services. Accurately identifying boundaries is solely the client’s responsibility. Any plans or specifications that are part of the contract must be supplied to Oliver Constructions FNQ. -
Site Preparation & Access
The owner must remove any furniture or personal goods from the work vicinity to minimize the risk of damage. Additionally, the owner must provide access for the contractor, employees, and subcontractors to carry out work as required during statutory work hours. Any personal property likely to impede the work must be removed by the owner. -
Timber Fencing Warranty
The warranty for timber fencing excludes warping, cracking, and bowing, as timber is a natural product, and these occurrences are beyond the control of Oliver Constructions FNQ. -
Quotations & Price Adjustments
All quotes are estimates only and are subject to change. Any changes to orders or product specifications will require a revised quotation. The contract price may vary due to contract conditions, including but not limited to variations. -
Scope Changes & Variations
If the scope of work changes due to unforeseen conditions, Oliver Constructions FNQ will notify the client before proceeding. All additional costs due to variations must be agreed upon in writing through an Amendment to Contract and are payable by the client. -
Payment Methods & Deposits
Credit card payments are accepted but incur a 2.2% surcharge. Please call 4936 6186 for credit card payments. Deposits are non-refundable once the contract has been accepted. Payment of a deposit confirms agreement to the Conditions of Engagement and entry into a binding contract. -
Material Over-Ordering
Certain materials may require a 5-10% over-order, which remains the property of Oliver Constructions FNQ. By entering into the contract, the client agrees to the contract price regardless of material quantities ordered. -
Job Variations & Confirmation
All variations to the job must be confirmed in writing by the customer before any additional work is undertaken. -
Underground Services
Unless the quotation includes underground services, Oliver Constructions FNQ will take all reasonable care to avoid damaging underground pipes or services. However, if damage occurs, we will notify the customer and repair the damage where feasible. Some costs may be passed on to the customer. Clients may request an underground services search at an additional cost. -
Excavation & Soil Conditions
Quotations assume standard soil conditions for excavations and footings unless otherwise stated. If substantial rock, roots, or concrete is encountered, an additional per-hole rate will be charged to cover extra removal time. -
Project Timelines & Delays
Oliver Constructions FNQ will endeavor to start and complete work as scheduled. However, delays may occur due to weather, client-initiated changes, contract amendments, staff availability, or product supply issues. -
Workmanship Guarantee
Oliver Constructions FNQ guarantees to rectify any workmanship issues. If the client is not satisfied with the final result, we will work with them to ensure full satisfaction, within reason. This guarantee excludes defects in timber, as outlined in Section 4. -
Product Alterations & Maintenance
Oliver Constructions FNQ is not responsible for repairs or replacements if the product has been altered or if negligence in maintenance has led to issues. -
Acceptance of Terms & Consumer Buying Guide
All clients acknowledge that they have reviewed the full terms and conditions available on our website: www.oliverconstructionsfnq.com, including the Consumer Buying Guide for contracts over $5,000. Any inquiries should be directed via phone or email. -
Deposit & Progress Payments
A 10% deposit is required before work commencement. Payment of this deposit confirms contract acceptance and agreement to Oliver Constructions FNQ’s Terms and Conditions. A 50% progress payment is required on the day of material delivery. If this payment is delayed, we reserve the right to postpone the installation date until payment is made. -
Final Payment & Debt Recovery
Full payment is required within three (3) business days of job completion unless otherwise arranged. Any costs incurred in debt recovery will be the responsibility of the client.
